1. Acceptance of These Terms
These Terms of Use (“Terms”) govern your use of truenorthchristmaslights.com, including all pages, forms, the website chatbot, and the free AI-powered estimate tool (together, the “Site”). The Site is operated by True North Christmas Lights (“we,” “us,” or “our”).
By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.
2. Eligibility
You must be at least the age of majority in your province or territory to submit an estimate request or book services with us.
By submitting an estimate request, you confirm that you own the property or are authorized by the owner to request lighting work on it.
3. AI Estimate Tool
Our free estimate tool gives you a quick, preliminary idea of what a lighting installation may cost. It is a starting point, not a final price.
How it works. The tool uses your property address to retrieve mapping and satellite or street-level imagery through Google Maps Platform. If you upload photos, they are analyzed using artificial intelligence services, including Google AI (Gemini) and OpenAI (ChatGPT), to approximate rooflines, dimensions, and features. Our team may review or adjust the result before sending it to you.
Estimates are not quotes. Any estimate produced by the tool is non-binding and provided for information only. It is not a quote, offer, contract, or guarantee of price, materials, scheduling, or availability. Final pricing is confirmed only in a written quote from our team, which may require an on-site visit.
Accuracy limits. AI-generated results can be wrong. Imagery may be outdated, low resolution, or blocked by trees, snow, or other structures, and property boundaries may be approximate. Final pricing may differ because of roof pitch, height, access, power outlet locations, electrical capacity, design changes, weather, or conditions not visible in imagery or photos.
Your responsibilities. When using the tool, you agree to:
- Enter an accurate address for a property you own or are authorized to represent
- Upload only photos you took or have the right to share
- Avoid uploading photos of people, licence plates, or anything unrelated to your property where possible
- Not submit false, misleading, or automated requests
Not for safety or structural use. Measurements and estimates from the tool are not structural, engineering, electrical, or safety assessments and should not be relied on for those purposes.
4. Website Chatbot
The chatbot on our Site is AI-powered and answers general questions about our products and services. It can make mistakes, and its responses are not binding commitments or professional advice.
The chatbot does not provide pricing or estimates. For pricing, please use the estimate tool or contact us directly. Do not share payment card numbers, passwords, or other sensitive information in the chatbot.
5. Content You Submit
You keep ownership of the photos, messages, and other information you submit (“Your Content”). You grant us a non-exclusive, royalty-free licence to store, copy, and process Your Content to prepare your estimate, provide our services, communicate with you, and improve our estimating process, as described in our Privacy Policy.
We will not use your uploaded photos in our marketing without your permission. You confirm that you have the right to submit Your Content and that it does not violate anyone else’s rights.
6. Acceptable Use
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms
- Submit false information or requests on behalf of others without their authorization
- Upload malicious code, or content that is offensive, infringing, or unrelated to an estimate request
- Scrape, harvest, or collect data from the Site or estimate tool by automated means
- Attempt to probe, disrupt, overload, or gain unauthorized access to the Site, its servers, or connected systems
- Reverse engineer, copy, or resell the estimate tool or its outputs
- Use the chatbot or estimate tool to generate content for purposes unrelated to our services
We may restrict or block access to anyone who violates these Terms.
7. Intellectual Property
The Site and its content, including text, photos and videos of our installations, product descriptions, logos, designs, and the estimate tool, are owned by True North Christmas Lights or our licensors and are protected by Canadian and international intellectual property laws.
You may view and print Site content for personal, non-commercial use. You may not copy, modify, distribute, or use it for commercial purposes without our written permission.
8. Third-Party Services and Links
The Site relies on third-party services, including Google Maps Platform, Google AI (Gemini), and OpenAI (ChatGPT). Your use of Google Maps features on the Site is subject to the Google Maps/Google Earth Additional Terms of Service and the Google Privacy Policy.
The Site may also include embedded content or links to other websites, such as social media. We are not responsible for the content, availability, or practices of third-party sites and services.
9. Quotes, Services, and Payment
Installation, removal, product sales, and other services are governed by a separate written quote or service agreement. If that agreement conflicts with these Terms, the agreement applies.
Product details, specifications, and prices shown on the Site may change without notice. We may correct errors in pricing or descriptions at any time, including after an estimate has been generated.
10. Disclaimers
The Site, the estimate tool, and the chatbot are provided “as is” and “as available.” To the extent permitted by law, we make no warranties, express or implied, about their accuracy, completeness, reliability, or availability, or that they will be error-free or secure.
11. Limitation of Liability
To the maximum extent permitted by law, True North Christmas Lights will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, including reliance on any estimate or chatbot response.
Our total liability for any claim related to your use of the Site is limited to $100 CAD. This section does not apply to services provided under a written quote or service agreement, which are governed by that agreement.
Nothing in these Terms limits any rights you have under applicable consumer protection laws that cannot be waived.
12. Indemnity
You agree to indemnify and hold harmless True North Christmas Lights from claims, losses, and expenses (including reasonable legal fees) arising from your misuse of the Site, Your Content, or your violation of these Terms.
13. Site Availability
We may change, suspend, or discontinue any part of the Site, including the estimate tool or chatbot, at any time without notice. We are not liable if the Site or any feature is unavailable.
14. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. Any dispute will be handled in the courts of Alberta, unless applicable law requires otherwise.
15. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the Site after changes are posted means you accept the updated Terms.
